Terms of use

1. Who we are, and what these terms cover

These terms are an agreement between you and Ticon, Inc. ("Ticon", "we", "us"), a corporation registered in Delaware, United States, at 6192 Coastal Highway, Lewes Delaware 19958.

They govern your use of the TrafficZoom website at trafficzoom.co, the TrafficZoom platform at app.trafficzoom.co, our documentation at docs.trafficzoom.co, our API, and any reports or data we make available through them (together, the "Service").

By using the Service you accept these terms. If you are accepting them for an organisation, you confirm you are authorised to bind it.

2. Changes to these terms

We may update these terms as the Service changes or the law requires. The date above shows when they were last revised. If a change materially reduces your rights, we will notify account holders by email before it takes effect. Continuing to use the Service after that means you accept the revised terms.

3. What the Service provides

TrafficZoom publishes modelled estimates of road traffic in the United States: annual average daily traffic, hourly and seasonal profiles, truck volumes, vehicle-miles travelled, travel times, congestion measures and area-level driver demographics.

County-level pages on trafficzoom.co are free to read and require no account. The TrafficZoom platform, custom corridor reports and API access are paid services.

The Service is provided for planning, screening, research and commercial analysis. It is not a certified traffic study and not an official government count. See clause 10.

4. Accounts

To use the platform you need an account. You agree to give accurate registration details, to keep your credentials confidential, and to tell us promptly at info@ticon.co if you believe your account has been compromised. You are responsible for activity under your account. Accounts are for the named user or organisation and may not be shared beyond the seats you have purchased.

5. Subscriptions, fees and refunds

- Fees, included volumes and usage limits are those shown at the time of purchase.
- Subscriptions renew automatically for the same period until cancelled. You can cancel at any time; cancellation takes effect at the end of the current billing period, and you keep access until then.
- Refunds: No refunds for partial billing periods.
- We may change prices for future billing periods with at least 30 days' notice.
- You may not create multiple accounts, projects or billing entities in order to avoid or reduce fees, or to exceed the limits of a plan.
- Fees are exclusive of taxes unless stated otherwise. Non-payment may lead to suspension under clause 15.

6. What you may do with our data

You may view, copy, print, download, analyse and republish figures from our public pages — including in commercial reports, presentations, proposals, articles and client deliverables — provided that:

- you attribute them to TrafficZoom and, where the format allows, link to the page the figure came from;
- you do not alter the figures or present them as something other than TrafficZoom estimates;
- you keep any copyright or attribution notices intact.

Data obtained through a paid subscription or the API may be used inside your organisation and in deliverables for your clients, subject to the limits of your plan and clause 7.

7. What you may not do

You may not:

1. scrape, crawl, bulk-download or systematically extract the Service, except through the API within the limits of your plan;
2. resell, sublicense or redistribute our data as a standalone dataset, a data feed, or as the substance of a competing product or service;
3. build a product or service that replicates the features of the Service using data extracted from it;
4. trace, digitise or derive road geometry, buildings or other map elements from our maps, or extract coordinates for use in another product;
5. copy or use any software, proprietary process, model or technology embodied in or described by the Service;
6. present our estimates as certified counts, official government figures, or the output of a licensed engineer;
7. use the Ticon or TrafficZoom names, logos or product names without our written permission, except to attribute a figure as clause 6 requires;
8. circumvent fees, usage limits, access controls or rate limits;
9. interfere with the Service, probe it for vulnerabilities, or use automated means that place an unreasonable load on it;
10. use the Service in breach of applicable law, or in the way clause 8 prohibits.

8. No decisions about individuals

This clause matters more than the others, so it is separate.

You may not use the Service, or any data obtained from it, to make or inform decisions about specific individuals or households. That includes tenant screening, credit or lending decisions, insurance underwriting or pricing, employment or tenancy decisions, and any other decision about a person based on the characteristics of the area they live in or travel through.

Ticon is not a consumer reporting agency, and nothing we provide is a consumer report or an investigative consumer report under the Fair Credit Reporting Act (15 U.S.C. § 1681 et seq.). Our data is not collected, verified or intended for any purpose listed in that Act.

Using area-level data in this way may also violate the Fair Housing Act, the Equal Credit Opportunity Act, state and local fair housing and lending law, and equivalent legislation elsewhere. You are responsible for your own compliance, and you indemnify us under clause 17 for claims arising from such use.

9. Feedback

If you send us suggestions or feedback, we may use them without obligation or compensation to you. You keep any rights you have in the underlying ideas.

10. Accuracy, and the absence of warranties

Our figures are modelled estimates produced by the methods described on our Methodology page. We publish our measured error rates openly — currently an average absolute error of 11.2% against hardware counts, with a maximum of 20% at a 90% confidence level — and we correct errors when they are reported to us.

Beyond that: the Service and all data in it are provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including any implied warranty of accuracy, completeness, merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, secure or free from errors, viruses or malicious code.

11. No professional advice

Nothing in the Service is legal, financial, investment, insurance or professional engineering advice, and it does not replace a certified traffic study, a sealed engineering opinion, or any analysis that a permitting authority, lender or regulator requires. Decisions you make using our data are yours.

12. Third-party data, sources and links

The Service incorporates data published by third parties, including state Departments of Transportation, the US Census Bureau and OpenStreetMap contributors, each under its own licence and terms; OpenStreetMap data is © OpenStreetMap contributors and available under the Open Database License. We also link to websites we do not control and are not responsible for their content.

13. Intellectual property

The Service — including its design, text, databases, models, derived estimates, software and documentation — is owned by Ticon, Inc. or its licensors and is protected by copyright and other laws. Underlying public data remains subject to the licences of its publishers. "Ticon", "TrafficZoom", the Ticon logo and our product names are trademarks of Ticon, Inc.

Nothing in these terms transfers ownership. Clause 6 is a limited licence to use published figures, not a transfer of rights in the dataset.

14. Suspension and termination

We may suspend or terminate access if you breach these terms, if your account is used unlawfully, if payment fails, or if we are required to by law. Where it is reasonable to do so, we will warn you first and give you a chance to fix the problem. You may stop using the Service at any time. Clauses 8, 10, 13, 16, 17 and 18 survive termination.

15. Limitation of liability

To the fullest extent permitted by law:

- we will not be liable for any indirect, special, incidental, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost business, lost data or lost opportunity, whether or not we were told such damages were possible;
- we will not be liable for decisions taken, or investments made, in reliance on our estimates;

Nothing here excludes liability that cannot lawfully be excluded, including for fraud or for death or personal injury caused by negligence.

16. General

If any provision is held unenforceable, the rest remain in force. Our failure to enforce a provision is not a waiver of it. You may not assign these terms without our consent; we may assign them to an affiliate or in connection with a merger or sale of assets. These terms, together with the Privacy Policy, Cookie Notice and Data Disclaimer, are the entire agreement between us about the Service. Neither party is liable for failures caused by events beyond its reasonable control.
